Bibliotheken en archieven niet gelukkig met uitbreiding auteursrecht


De Vlaamse bibliotheken, archieven en documentatiecentra betreuren ten zeerste de beslissing van het Europees Parlement om het auteursrecht op geluidsopnamen te verlengen van 50 tot 70 jaar. Deze beslissing hypothekeert erfgoed- en digitaliseringsprojecten en belemmert artistiek hergebruik. Bovenal zal de gewone artiest weinig voordeel halen uit deze verlenging. Vooral supersterren en grote platenmaatschappijen winnen erbij.

Voordeel voor de groten

Op donderdag 23 april stemde het Europees Parlement voor een voorstel van de Europese Commissie om de beschermingstermijn op geluidsopnamen voor producenten en uitvoerende kunstenaars te verlengen. De commissie stelde voor om de termijn te verhogen

van de huidige 50 jaar tot 95 jaar na de opname. Het parlement heeft de uitbreiding echter beperkt tot 70 jaar, de termijn die ook geldt voor onder meer letterkundige werken. Dit wil zeggen dat vanaf nu artiesten en platenmaatschappijen in 2009 nog altijd een vergoeding kunnen ontvangen voor het gebruik van opnames die ze in 1939 maakten. Volgens Europees commissaris McCreevy zullen vooral artiesten profiteren die in de jaren 1960 opnamen maakten (zonder de uitbreiding tot 70 jaar dreigden die binnenkort die inkomsten te verliezen).

In de praktijk zullen vooral de grote platenmaatschappijen hier inkomsten uit halen, en de supersterren, zoals The Beatles of Elvis Presley, die na 50 jaar nog altijd populair zijn. Alle anderen kunnen misschien nog kleine bedragen innen die, naarmate de tijd vordert, over steeds meer erfgenamen verdeeld moeten worden. �Misschien', want vaak betalen de producenten een eenmalige afkoopsom en ontvangt de artiest nadien niets meer.

Breed front tegen uitbreiding auteursrecht

Opnames die commercieel niet meer interessant zijn, zullen voor decennia in de kluizen en archieven van de muziekindustrie verdwijnen. Misschien worden ze nog aangeboden via een gespecialiseerde online winkel, maar ze blijven in elk geval bijna een eeuw lang uit het publieke domein. Een artiest die zich erdoor laat inspireren en een �remix' maakt, een bibliotheek of archief die oude opnames wil digitaliseren en gebruiken in een erfgoedproject: ze kunnen het alleen met toestemming van de rechthebbenden. Producenten kunnen fusioneren, overgenomen worden of failliet gaan. Wie speelde er mee in de band? Worden de artiesten vertegenwoordigd door een auteursvereniging? Leven ze nog? Zo niet, wie zijn hun erfgenamen? Wie dit muzikale erfgoed nog wil gebruiken, wacht een lange en moeizame zoektocht.

Niet alleen bibliotheken, archieven en documentatiecentra verzetten zich tegen deze uitbreiding van het auteursrecht. Ook de Vlaamse Interuniversitaire Raad (VLIR) en de Vlaamse Hogescholenraad (VLHORA) spraken zich uit tegen dit voorstel. Juristen gespecialiseerd in het auteursrecht vinden deze maatregel moeilijk te verrechtvaardigen en bovendien ineffici�nt. De professoren Marie-Christine Janssens (KU-Leuven) en Severine Dusollier (FUNDP Namen) spraken zich in De Standaard van 18 maart 2009 uit tegen de verlenging. Ze volgen daarin onder meer Bernt Hugenholtz, directeur van het gerenommeerde Instituut voor Informatierecht in Amsterdam. Hugenholtz onderzocht in opdracht van de Europese Commissie de effecten van een mogelijke verlenging en concludeerde dat deze niet wenselijk is.

Besluit

De bibliotheek- en archiefsector erkent het nut van het auteursrecht, dat in eerste instantie bedoeld is om de creativiteit te stimuleren. Uitbreiding van de beschermingstermijn voor geluidsopnamen heeft echter als belangrijkste effect dat platenmaatschappijen hun lucratieve handel in de creaties van enkele supersterren langer kunnen behouden. Deze verlenging zou wel eens de doos van Pandora kunnen openen. We kunnen nu verwachten dat spoedig een �harmonisering' volgt. Er wordt nu al een uitbreiding gevraagd voor de bescherming van audiovisuele werken. De Europese commissaris voor economie gaat in op de verzuchtingen van enkele grote internationale mediabedrijven, ten koste van een dynamisch cultuurbeleid van de Europese Unie. Binnenkort kan de Europese Commissie haar eigen ambitieuze digitale bibliotheek Europeana opdoeken.

The legendary Tokyo Dawn Records relaunches its netlabel annex website/blog. The Frankfurt am Main based netlabel is one of the oldest netlabels (�1997) and is well-known for its loungy, triphoppy, jazzy style.
